Fibre slower than promised

When I signed up to talktalk in January 2016 I was promised a download speed of between 23Mb and 37Mb on medium fibre. It was installed on the 21st January 2016 and on doing a speed test I was indeed receiving 34Mb which I was very happy with. I tested my speed on a regular basis and was receiving a steady speed of between 32Mb and 35Mb for the first month. The speed then started to die away and eventually dropped to below 16Mb. Less than the promised speed. I have had very little help from the fault management team. Everytime i ring them they tell me to test the same things as the person the night before did. Eventually they booked me a BT engineer. He arrived tested the line and informed me that I should never have been promised a speed of 23Mb to 37Mb as the line is only capable of carrying 18Mb. Classic case of mis selling. How come I was recieving 34Mb I asked him. Aparrently the line will carry that at first but due to the noise on the line it will never ever be maintained. I am getting no joy at all when I ring talktalk so I thought I would try here before I cancel my DD and throw the router in the bin.
